These Terms of Service (“Terms”) govern your use of the Saltwater Swim School website and participation in our swimming lessons, programs, bookings, and related services. By accessing our website or enrolling in a class, you agree to these Terms.
If you do not agree, please do not use our services.
1. About Us
Saltwater Swim School (“we”, “our”, “us”) provides swimming education, water safety instruction, and aquatic programs for infants, children, and adults.
Our website allows users to:
- view class information
- make enquiries
- register students
- manage bookings
- receive updates regarding lessons and programs
2. Eligibility
By enrolling a student you confirm:
- You are at least 18 years old, or
- You are the parent or legal guardian of the enrolled participant
- All medical and safety information you provide is accurate
You agree to supervise any child under your care while on the premises unless the child is participating in a supervised class.
3. Bookings & Enrolments
3.1 Class Placement
Students are placed into levels based on age, ability, and instructor assessment. We reserve the right to move students to a different level if required for safety or learning progression.
3.2 Attendance
Students must:
- arrive at least 5 minutes before the lesson
- be ready at poolside
- follow instructor directions
Late arrivals may result in shortened lesson time.
4. Fees & Payments
- All fees must be paid in advance unless otherwise agreed
- Fees are displayed on the website or booking system
- Payments may be made via online checkout or approved payment methods
Failure to pay may result in suspension of enrolment.
We may change pricing at any time with reasonable notice.
5. Missed Lessons & Make-Up Classes
Missed classes are not guaranteed to be refundable.
Make-up lessons may be offered where:
- sufficient notice is provided (typically 24 hours)
- availability exists
Make-up lessons:
- cannot be exchanged for cash
- cannot be transferred to another student without approval
- expire if not used within the specified period
6. Cancellations & Refunds
Refunds are generally not provided except where required under Australian Consumer Law.
We may provide credits at our discretion for:
- medical reasons (documentation may be required)
- facility closures
- instructor unavailability
We reserve the right to cancel or reschedule classes due to:
- pool conditions
- safety risks
- instructor illness
- operational reasons
7. Health & Safety
You must inform us before lessons if a student has:
- medical conditions
- disabilities
- injuries
- infectious illnesses
Students must not attend lessons if they:
- have diarrhoea, vomiting, fever, or contagious illness
- have open wounds
- are medically unfit to swim
We may refuse participation if we believe attendance presents a safety risk.
8. Behaviour & Conduct
All participants and parents must behave respectfully.
We may suspend or cancel enrolment if a person:
- behaves aggressively
- disrupts lessons
- ignores safety directions
- places others at risk
No refund will be provided in such cases.
9. Supervision & Parental Responsibility
Parents/guardians remain responsible for children:
- before and after lessons
- in change rooms
- in spectator areas
The swim school is not a child-minding service.
10. Photography & Media
From time to time we may photograph or record lessons for:
- training
- promotional material
- social media
We will seek consent during enrolment. You may opt out at any time by notifying us in writing.
Parents may photograph their own child only and must not photograph other students.
11. Risk Acknowledgement & Liability Waiver
Swimming and aquatic activities involve inherent risks including injury or drowning.
By enrolling you acknowledge:
- participation is voluntary
- risks exist even with supervision
- you accept those risks on behalf of yourself and the participant
To the maximum extent permitted by law, Saltwater Swim School is not liable for:
- personal injury
- loss of property
- accidents occurring outside supervised class time
Nothing in these Terms excludes rights under the Australian Consumer Law.
12. Website Use
You agree not to:
- misuse the website
- attempt to hack or disrupt systems
- upload harmful software
- impersonate another person
We may suspend access for misuse.
13. Privacy
We collect personal information to:
- manage enrolments
- ensure student safety
- communicate with families
- process payments
Your information is handled according to our Privacy Policy.
14. Changes to Terms
We may update these Terms at any time. The latest version will always be published on this website.
Continued use of our services means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes will be handled in the courts of Victoria.
